Family Demands Justice In Toddler's Death As DHS Investigates Couple Caring For Him - news9.com KWTV

The family of an Oklahoma toddler is demanding justice after they say the child died in the care of two acquaintances.

Family of Zavien Kinyon told News 9 the couple who watched the 2-year-old claims the boy fell off a bunk bed.

Kinyon's grandma said the toddler sustained a severe head injury and then passed away three days later.

The couple watching Kinyon, the Blackerbys, are not charged with any crime. But Kinyon's family does not believe this was an accident.

Family and other people that know the Blackebys reached out to News 9. Multiple people claimed to have seen evidence of past abuse with other kids.

"We've seen Roger slap him across the face," said a family member that did not want to be named. "I mean people in my family have; we've called CPS, we've called several times."

The same woman said she also feared what happened was an accident.

"They have children in that house, my little cousins which is their granddaughter's kids," said the family member.

She said she trusted her uncle and aunt to watch her own kids one time and never felt comfortable again.

Ashley Cronister told News 9 she lived in the Blackerbys home with her boyfriend's kids for about six months.

She said she witnessed kids getting put in the corner, being "beat" if they left and seeing their head shoved in a corner.

News 9 did not find any child abuse charges in the couple’s past but did reach out to Oklahoma DHS.

The agency sent us this statement:

"Our hearts break for the Kinyon family in their terrible loss. OKDHS can confirm that we have an open investigation regarding unlicensed child care provided by the Blackerby’s and are working with law enforcement in this case. When a family has child care needs, we urge all Oklahoma families to seek licensed, quality child care in their area by visiting our Child Care Locator at http://childcarefind.okdhs.org/childcarefind/."

 The toddler's family is now praying for answers.

"I don't understand why someone isn't in jail for at least child neglect," said Zavien's grandmother Saroya Kinyon.

The OSBI is also investigating but could not give any further information.

News 9 called and reach out to the Blackerbys but did not hear back.
