Hochul says masks will be mandatory in day care centers - Times Union

ALBANY — Employees and children in New York's state-regulated day care centers will be required to immediately resume wearing masks as COVID-19 spread among children has been a cause for concern across the nation, Gov. Kathy Hochul said Wednesday.

"We don't have a vaccine available for 5- to 11-year-olds," Hochul said during a COVID-19 briefing at the Capitol. "We're not hearing that that will occur for a number of months yet."

The governor's office said the requirement — for those age 2 and up to wear face coverings — applies to state Office of Children and Family Services "licensed and registered child care centers, home-based group family and family child care programs, after-school child care programs and enrolled legally exempt group programs during operational hours."

The new directive falls in line with guidance from the U.S. Centers for Disease and Prevention that recommends "universal indoor masking by all students (age 2 and older), staff, teachers, and visitors to K-12 schools, regardless of vaccination status."

The mask mandate will also extend to state-regulated congregate facilities, the governor said.

The state is also ramping up in preparation for mass vaccinations of coronavirus vaccine booster shots, which Hochul said could begin before the end of the month. There is a plan to provide training to emergency medical technicians to allow them to administer vaccination shots, which Hochul said could add about 50,000 people capable of giving the shots.

"We all want this to be over. Everybody's tired of it," Hochul said. "We have the power to end this if every single person in the state of New York ... over the age of 12 ... will simply get their vaccine."

The state will challenge a federal judge's order issued Tuesday that will temporarily restrain employers from enforcing a state vaccine mandate on health care workers who have sought a religious exemption from receiving the shots.

The order, set to go into effect in part on Sept. 27, will be the subject of a court hearing the following day. State and federal officials have set a series of vaccine deadlines for several population groups. 

Hochul said the state is hopeful of making "overwhelmingly persuasive arguments" to U.S. District Judge David N. Hurd in favor of allowing the state to enforce the mandate for health care workers.

Many health care facilties, including hospitals, could see roughly 30 percent of their workforces cut if employees decline to be vaccinated. 

The ruling by Hurd involved a constitutional challenge to the mandate in a case filed on behalf of 17 medical professionals.

The governor said the state takes the position that health care workers have an obligation to be vaccinated in the interest of keeping the facilities staffed and treating individuals who are vulnerable to COVID-19 symptoms.
